You or your attorney will be given an opportunity to meet with a Prosecutor to review the facts supporting the state's criminal charges against you. At the pre-trial conference, you are entitled to review a copy of the complaint(s), any written police reports or any other evidence that the state intends to use at the trial. Depending on the alleged offense, you may be entitled to a trial by jury. You are entitled to hear all testimony introduced against you. You have the right to cross-examine any witness who testifies against you. You have a right to testify on your own behalf. You also have a Constitutional right not to testify. If you choose not to testify, your refusal cannot and will not be used against you in determining your guilt or innocence. However, if you do choose to testify, the Prosecutor will have the right to cross-examine you. You may call witnesses to testify on your behalf. If you decide to appeal a decision made against you for a criminal violation, or a citation with both criminal and civil traffic violations, you must file a NOTICE OF APPEAL with the Cottonwood Municipal Court within 14 calendar days from date of judgment. If you fail to file an appeal before this time period expires, you will lose your right to appeal.Criminal Offenses

There is a $17 appeal compact disk (CD), preparation fee assessment. This fee covers the cost of making a CD of the proceedings and must be paid the same day that the notice of appeal is filed. If more than one CD is required (if the hearing is longer than 60 minutes), you will be required to obtain the services of a court reporter to prepare a written transcript. You will be charged for the preparation of the transcript. In the event that you must hire a court reporter, you may set up a payment arrangement with the court reporter directly and the $17 appeal CD preparation fee will be refunded to you. An appeal bond may not be required to stay the conviction and sentence on a criminal case. Upon receipt of your notice of appeal and your written memorandum, the Cottonwood Municipal Court will forward a complete copy of your case to you and the state. A memorandum is a written statement that you send to the Cottonwood Municipal Court setting forth the legal issues and legal reasons why you are appealing the judgment of the Cottonwood Municipal Court. Once the Cottonwood Municipal Court has received both the appellate memorandum (from the party filing the appeal) and appellee memorandum (from the opposing party), the case will be forwarded to the Yavapai County Superior Court. Failure to pay any costs or fees, or to respond to any notices from the Municipal Court or Superior Court may result in your appeal being dismissed. An appeal is a legal process in which a higher court (Yavapai County Superior Court) reviews the decision of a lower court (Cottonwood Municipal Court) based on the audio or transcribed record of your hearing. An appeal is not a retrial of your case, and you cannot present new evidence or testimony. You are responsible for all appeal charges/fees. You may appeal civil traffic findings, criminal rulings and civil orders. Possible scenarios include:

Both services are scanned fingerprints rather than ink. Scanning saves time and reduces the need for reprints.

Arizona State Law requires children to be in a child restraint system (car seat) until their fifth birthday. There is no longer a weight exception. A booster seat is also required for a child who is at least five years old but under the age of eight and who is not more than four feet nine inches tall. Seats in cars are designed for use by adults so consequently little people do not fit properly. The lap belt should fit snuggly across the hips not the stomach. In a collision a lap belt across the stomach will put too much pressure on internal organs which will result in injury. The shoulder belt should fit over the shoulder and across the chest. At no time should the shoulder belt cross the neck. Many children will place the shoulder harness behind there back to avoid it rubbing on the neck. This is like not wearing a seat belt at all. The seat belt was not designed to be worn like this and will not provide adequate protection in a collision. There are many items that are available to make the seat belt fit the child. These include extra belts and clips that attach to the seat belt itself to squeeze it down to fit the child. Most of these items are not crash tested so it is unknown how they would perform in a collision. The only safe way is to make the child fit the seat belt. This is done by using a booster seat. This makes the child sit taller so the seat belt will fit correctly across their body. Many people ask which is the best child seat available. The answer is to get the one that will best fit your car, your child, your budget, and one that you will use every time your child gets in the car.Police Department

The 2024 International Building Code Section 105.1 states "Any owner or owner's authorized agent who intends to construct, enlarge, alter, repair, move, demolish, or change the occupancy of a building or structure, or to erect, install, enlarge, alter, repair, remove, convert or replace any electrical, gas, mechanical, or plumbing system. the installation of which is regulated by this code, or to cause any such work to be performed, shall first make application to the Building Official and obtain the required permit."

All contractors are required to be licensed through the State of Arizona, unless work falls under the Handyman Exemption A.R.S. Sec. 32-1121A.14. More information on licensed contractors can be found at https://roc.az.gov/ . Any work being done on a Manufactured Home or Factory Built Building will also need to be licensed through the State of Arizona. If building under the owner-builder exemption you do not have to have a contractor license.
An owner-builder is defined by: any individual or group of individuals who own the property on which they plan to construct, alter, repair, improve, or remodel a building or structure is considered an owner-builder.
Arizona Revised Statues (A.R.S.) § 32-11214.5 is an exemption in the state licensing law that allows residential property owners to:
- Do the work themselves, OR
- Do the work jointly with their own employees, OR
- Do the work with duly licensed contractors
This exemption does not apply if the structure or group of structures, including improvements, is intended for sale or rent.
The offering of such structures for sale or for rent within one (1) year after completion or issuance of a certificate of occupancy is considered by law to be prima facie evidence of contracting without a license and that the construction project was not intended for the occupancy solely by the owner. The exemption in the statute in such cases are not applicable.
If an Owner/Builder elects to undertake a residential construction project on his/her own property, and hires his/her own employee, should be aware of possible requirements of other government agencies.
- Most employers have federal and state employer identification numbers and pay unemployment compensation insurance.
- Most employers deduct social security and federal income taxes from an employee's paycheck and file quarterly or annual reports.
- Owner/Builders should determine if their homeowner's insurance policy offers sufficient liability coverage, should the worker or workers be injured.
Handyman Exemption § 32-1121(A)(14). A person who does not hold a contractor’s license may bid for and accept work when the aggregate contract price, including labor and materials, amounts to less than $1,000 or in any case in which the performance of the work does not require a local building permit.

To schedule an inspection please log into the portal under the account previously set up. Select the portal for entry, the MY INSPECTION link will take you to the inspection request page where you can schedule an inspection for any current application, along with the inspection type and the requested date.
We will be phasing out the hotline, however it is still available at this time. Inspections called before 4:00 pm will be scheduled the next business day, all final inspections require a 48-hour notice.

A special event permit is required if a planned event meets any of the following criteria:
- A gathering with more than 100 people in a public setting that substantially deviates from normal use.
- Any event that is being held on City-owned property. This includes parks, indoor facilities, and public right-of-way (streets).
- Any event that requires a state-issued special event liquor license or extension of premises, typically when selling or serving alcohol.
- Any event that utilizes multiple City services above and beyond what is routinely provided.
- Any event that will disrupt the normal traffic flow, such as a parade, race, neighborhood party, or other similar activities.
- Any event that substantially deviates from the current land use.

Organizations or individuals planning to hold a special event with alcohol sales must submit an Arizona State Liquor License Special Event Application and a City of Cottonwood Special Event Application. The Arizona State Liquor License Special Event Application is administered by the City Clerk's Office and completed by the Arizona Department of Liquor Licenses & Control. The City Clerk's Office accepts the application and makes a recommendation to the state. For the Arizona Department of Liquor Licenses and Control procedures, please contact (602) 542-5141 or visit www.azliquor.gov. Liquor License Special Event Applications must be submitted to the City Clerk at least 60 days prior to the event to allow ample time for staff to review and schedule for consideration by the City Clerk.
Step 1. Submit the following:
- A signed Liquor License Special Event Application to the City Clerk's Office at tmayes@cottonwoodaz.gov or uploaded through the Cottonwood Special Event Permit Application Portal.
- A completed City of Cottonwood Special Event Application through our Special Event Application Submittal Portal.
Step 2. Await the City's approval or the Special Event Liquor License (if approved, you will be contacted to pick up your tentatively approved application).
Step 3. Take your tentatively approved Special Event Liquor License Application to the State of Arizona (Arizona Dept. of Liquor), located at 800 West Washington St., 5th Floor, Phoenix, AZ 85007.
Step 4. Await approval by the State agency (Arizona Dept. of Liquor). You will be emailed an approved Special Event Liquor License permit if approved. Forward the approved license to rcays@cottonwoodaz.gov to be included in your City of Cottonwood Special Event Permit.
Step 6. Await approval by the City of Cottonwood for your Special Event Permit.

Step 2. Await approval by the City (if approved, you will be contacted to pick up your tentatively approved application).
Step 3. Take your tentatively approved application to the State of Arizona (Arizona Dept. of Liquor), located at 800 West Washington St., 5th Floor, Phoenix, AZ 85007.
Step 4. Await approval by the State agency (Arizona Dept. of Liquor). If approved, you will be contacted again by the City of Cottonwood to pay the $25.00 application fee, and you will be emailed an approved permit.

Food Vendors
A special event permit is required if an event on the City of Cottonwood property distributes food to the public.
If an event coordinator plans to have food trucks or other food-selling vendors on site for an event on the City of Cottonwood property, coordinators must provide the City of Cottonwood a copy of all vendors' Yavapai County food vendor permits and a current proof of Fire Certification.
Additional insurance may be required.
Merchant Vendors
For all other merchant vendors, a complete list of vendors for any event being hosted on the City of Cottonwood's property will be required prior to a Special Event Application being approved. Some vendors may be required to submit a Certificate of Insurance as well.
Rentals (stages, jumping castles, entertainment, portable restrooms, etc.)
A list of vendors providing services for your event will be required. Insurance requirements for each vendor will be in effect.

The Environmental Health Unit (Unit) at Yavapai County Community Health Services (YCCHS) regulates and issues "temporary food service establishment" permits for food and beverage concessions at special events in Yavapai County. It is the Unit’s responsibility to regulate the food sold at these events. If food or drink is not prepared and handled in a sanitary manner, the public's health may be at risk.
In order to sell or give away any food or beverage product at an event,
you are required to apply for a "Special Event License."You can find all the information needed and the link to the application here. You will need to submit your Special Event Food Vendor Application no later than THREE WEEKS out from the event.

If an event is taking place on City of Cottonwood property, a special event permit will be required. This includes parks, plazas, indoor facilities, and public right-of-way (streets).
If you're interested in renting a park or indoor facility for your event, go to https://secure.rec1.com/AZ/cottonwood-az/catalog and log in or create an account to check facility availability. If you have additional questions about renting city property for an event, call the Parks and Recreation office at 928-639-3200 or email us at reservations@cottonwoodaz.gov.
If an event is taking place in commercial areas or private property, written permission from the property owner will be required unless the event coordinator (or the organization the coordinator works on behalf of) owns the property.

Special Event Permits F.A.Q.
If your event occurs on city streets or impacts traffic on public roadways (including streets, sidewalks, and the area in between), you must submit a traffic control plan. Traffic Control Plans are a two-part permitting process subject to separate review times.

- All traffic control plans (TCPs) must be submitted to the City Engineering Department and approved before event permit approval. All TCPs with their cover sheet can be emailed to jbramble@cottonwoodaz.gov
- You may contact a barricade company to help you with traffic barricades and for assistance with creating a traffic control plan.
- Additional insurance may be required from the agency performing the traffic control or supplying equipment.
Street closures and street barricades for large special events are permitted through the special event permit application process. A traffic control plan and detailed site plan should be included if public streets will be closed.
ALL TRAFFIC CONTROL PLANS ARE SUBJECT TO A COMPHRENSIVE REVIEW.

Submitting an application for a Special Event is $50 per application. The application fee must be paid at the time of submission and is nonrefundable. Payment can be made in person at the Cottonwood Recreation Center, online at https://secure.rec1.com/AZ/cottonwood-az/catalog, or staff can assist you over the phone at 928-639-3200.
Additional fees may be incurred for the use of public facilities, additional permits, and other related services (ex, an event in a park will be subject to park rental fees or require off-duty security at the applicant's cost).

Contact Officer Track (do we provide the link or od it for them?), a 3rd party off-duty management company, to inquire about hiring off-duty officers to perform security or provide traffic control for your event.
